Terms & Conditions of Sale

Last updated: 29 November 2025

These Terms & Conditions of Sale (“Terms”) explain the basis on which we supply products to you when you order from our website.

By placing an order with us, you agree to these Terms.

1. About Us

We are Baxton (“we”, “us”, “our”).

Address:
Baxton
Unit 1, Forrest Street
Blackburn
United Kingdom
BB1 3BB

You can contact us using the details on our Contact Us page.

2. Placing an Order

  • Product listings on our website are an invitation to order, not a binding offer.

  • When you place an order, you make an offer to buy the products in your basket.

  • We accept your order when we send you a dispatch/confirmation email. At that point a contract is formed.

  • If we cannot accept your order (for example, out of stock, pricing error, or payment issues), we will let you know and refund any money you have paid.

3. Prices and Payment

  • The price of a product is the price shown on our website at the time you place your order.

  • Prices may include or exclude VAT; this will be made clear at checkout.

  • Delivery charges are shown separately before you complete your order.

  • We accept the payment methods displayed at checkout.

  • Your order will not be dispatched until payment has been successfully processed.

4. Delivery

  • We will deliver the products to the address you provide at checkout.

  • Delivery times are estimates only, but we will try to meet any dates given.

  • If no one is available to receive the delivery, the courier may attempt re-delivery, deliver to a neighbour or return the parcel to us. Re-delivery charges may apply.

  • For deliveries outside the UK, you are responsible for any customs duties, taxes or import requirements.

5. Risk and Ownership

  • Risk in the products passes to you when they are delivered to the delivery address (or to any alternative recipient you nominate).

  • Ownership of the products passes to you once we have received payment in full (including delivery charges).

6. Your Right to Cancel (Consumers)

This section applies only if you are a consumer.

  • If you buy online, you normally have 14 days from the day after you receive the products to change your mind and cancel.

  • To cancel, you must clearly tell us (for example, by email).

  • You must send the products back to us within 14 days of telling us you want to cancel.

  • Unless the products are faulty or we have agreed otherwise, you must pay the cost of returning them.

  • We will refund the product price and the standard delivery charge, minus any reduction in value if you have used or damaged the products more than necessary to check them.

You cannot cancel in respect of certain items, for example:

  • Products made to your specification or clearly personalised;

  • Sealed items which cannot be returned for health or hygiene reasons if unsealed after delivery.

7. Faulty or Incorrect Products

  • We must supply products that are in line with your contract with us.

  • If a product is faulty, damaged or not as described, please contact us as soon as possible with details (and photos where helpful).

  • If we agree the product is faulty or incorrect, we will normally offer a repair, replacement or refund, in line with your legal rights.

8. Returns of Non-Faulty Products

  • We may accept returns of non-faulty products outside your legal cancellation period at our discretion.

  • Products must usually be unused, in original packaging and in a re-saleable condition.

  • You will be responsible for the return costs, and a restocking fee may apply if stated on our website or agreed in advance.

9. Liability

Nothing in these Terms limits or excludes our liability where it would be unlawful to do so, including for:

  • Death or personal injury caused by our negligence; or

  • Fraud or fraudulent misrepresentation.

If you are a consumer:

  • We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill.

  • We are not responsible for any loss or damage that is not foreseeable.

  • We only supply products for domestic and private use. If you use them for commercial or business purposes, our liability will be limited as for business customers.

If you are a business customer:

  • We exclude all implied terms, conditions and warranties to the fullest extent permitted by law.

  • We will not be liable for loss of profit, loss of business, business interruption, loss of data, or any indirect or consequential loss.

  • Our total liability to you for all claims under any contract will be limited to the total price of the products under that contract.

10. Governing Law

These Terms and any disputes arising out of them are governed by the laws of England and Wales.

  • If you are a consumer, you may bring legal proceedings in the courts of England and Wales, or in the courts of your home jurisdiction within the UK.

  • If you are a business customer, you agree that the courts of England and Wales will have exclusive jurisdiction.
